Renewable-energy challenge rejected
Another Arizona appellate court has rejected a legal challenge to state Corporation Commission rules requiring electric utilities to obtain a set percentage of their power from renewable sources.
The state Court of Appeals has declined to consider a special-action lawsuit filed last week by the Goldwater Institute, The Associated Press reported.
The lawsuit was filed with the midlevel appellate court after the Arizona Supreme Court declined to consider a similar suit also filed on behalf of utility customers.
The lawsuit alleges the commission exceeded its authority and intruded on the Legislature’s policymaking role when it approved the rules. The institute now plans to file a lawsuit in Maricopa County Superior Court.
